Warranty conditions

1. All goods purchased at www.eretail.lv have a manufacturer's warranty.
2. The manufacturer's warranty period for the goods varies, up to five years.
3. Information about the manufacturer's warranty period for the specific product can be found in the product description or it is possible to ask www.eretail.lv customer consultant.
4. In cases where the manufacturer has set a warranty period of less than two years for a product, the consumer is entitled to file a claim for non-conformity of the product within two years from the date of purchase.
5. The right to file a claim is valid if the goods were used only in the foreseeable circumstances and only in the household.
6. For legal entities other than the Consumer, only the warranty period specified by the Manufacturer is provided.

7. Please be informed that the manufacturer's warranty conditions are valid if the buyer can present:
7.1. a document confirming the purchase (check, bill of lading); 7.2. the manufacturer's or distributor's warranty card (if the manufacturer or distributor has included one in the product package).
7.3. You can find information about the certified service centers of the manufacturer on the manufacturer's or distributor's warranty card by calling the manufacturer's representative office or the distributor indicated on the product packaging, or by calling 61112470 or writing to e-mail: support@eretail.lv.

8. Please note that the warranty conditions do not apply to the product's accessories (such as accessories), batteries (such as batteries, accumulators), accessories that have limited resources (such as fuses, headphones, microphones).

9. The conditions of the manufacturer's warranty are not valid against damage caused by the fault of the buyer or user and they are:
9.1. the product has damage to warranty seals, serial numbers;
9.2. the product has not been used for its intended purposes and has not been operated in the manner specified in the instructions for use of the product;
9.3. scratched, broken constructions, cracked screen, poured water in places not intended for it, goods cared for by incorrect means, if unauthorized objects are found in the goods, insects are allowed to enter the products or any other traces indicating improper use of the goods;
9.4. if the damage is caused by non-compliance of the supply voltage, telecommunications, cable networks with the standards specified by the manufacturer, due to rapid temperature fluctuations, as well as other household and external factors, such as soot, smoke, dust, humidity, shocks, scratches;
9.5. if the product shows traces of unqualified repairs;
9.6. in cases of natural deterioration of the elements.
9.7. if the product uses non-standard power supplies, accessories and spare parts, as well as raw materials (for example, cartridges, toners, etc.) which have not been certified by the manufacturer for use with the specified product, and if this has caused damage to the product;
9.8. in addition to the equipment, the warranty does not apply - batteries, headphones, connecting cables, chargers, remotes).
9.9. if the goods have been used by the buyer for production or professional purposes (if the specific goods are not intended for such purposes);
9.10. the warranty does not work if the damage has occurred as a result of incorrect transportation of the goods.

10. In case the goods are damaged, the buyer has the following options:
10.1. go to the service center indicated in the manufacturer's or distributor's warranty card (taking with you the document confirming the purchase and the warranty card) - we recommend it as the fastest way to prevent damage to the product;
10.2. Apply for warranty service at any time by clicking on the "Apply for service" section, and our employee will contact you about further actions.
10.3. call 61112470, where an eretail.lv employee will listen to the buyer and suggest the best solution.

11. In case the warranty service is not valid, but the buyer refuses to pay for the repair, the buyer must cover the diagnostic costs, and the buyer receives a report from the Service Center on the damage found. If the buyer agrees to the repair of the charge, then the cost of diagnostics does not have to be covered.

12. Complaints and out-of-court dispute resolution procedures.
Please submit a complaint regarding the availability or quality of the goods electronically by sending an e-mail to support@eretail.lv or in writing by sending an address to Riga, Strēlnieku Street 15 - 11, LV-1010. The complaint will be considered within 15 working days from the date of receipt of the complaint, sending a reply to the contact address indicated in the complaint.
If the complaint is found to be unfounded and you do not agree with recognizing the complaint as unfounded, you have the right to use the alternative dispute resolution options specified in regulatory enactments by submitting a written application to the seller for out-of-court dispute resolution, indicating:
- name, contact information;
- the date of submission of the application;
- the nature of the dispute, the claims and the grounds for them.

We remind you that consumers have the right to file a claim for a product that does not comply with the terms of the contract within 24 months from the date of delivery of the product.

Rules on the exercise of the right of withdrawal


1. Right of withdrawal:

1. You have the right to withdraw from this agreement within 14 (fourteen) days without giving any reason.
2. The exercise of the right of withdrawal shall cease after 14 days from the date on which you have acquired or possession of the goods by a third party other than the carrier indicated by you.
3. In order to exercise the right of withdrawal, you must inform us of SIA “Wolteh”, legal address Riga, Strēlnieku Street 15 - 11, LV-1010, telephone number: 61112470, e-mail address: support@eretail.lv about the decision to withdraw from this contract.
4. In order for the right of withdrawal to expire, it is sufficient that you send your notice of exercise of the right of withdrawal before the expiry of the right of withdrawal.

You must request the delivery of the goods by calling 61112470 or sending an e-mail to support@eretail.lv, without undue delay and in any case no later than 14 days from the date you notified us of your decision to withdraw from this agreement. The deadline will be met if you also send the goods back to the address Riga, Strēlnieku Street 15 - 11, LV-1010, before the 14-day deadline. Please note that SIA Wolteh has the right to record possible visual damage to the goods, as well as the contents of the package, for the goods sent by Express Mail at the time of acceptance. In cases when sending the goods to the customer center of SIA Wolteh using courier mail, SIA Wolteh will establish the damage of the goods or the non-compliance of the goods with the visual condition and assembly at the time of receipt of the goods,
7. You will have to bear the direct costs of returning the goods. The maximum cost could be around € 50.
8. You are only liable for the depreciation of the goods if the goods have been used for purposes other than determining the nature, characteristics and functioning of the goods.
9. During the period of exercising the right of withdrawal, you have the right to use the product to the extent necessary to verify the nature, characteristics and operation of the product. (as much as it could be done before buying the product in a regular store, for example, laptops get acquainted with the appearance and size of the computer, but without any manipulation, including activating the operating system pre-installed on the computer; for mobile phones - without tearing the protective film, card and without making calls, synchronizing data, etc.). By exercising the right of withdrawal, you are responsible for using the product beyond what is intended to test the nature, characteristics and performance of the product. You are responsible for the use of the product during the period of exercise of the right of withdrawal which is incompatible with the principle of good faith, as well as for the value of the product,
SIA "Wolteh" asks consumers to use the product as much as necessary to check the nature, characteristics and operation of the product, for example, to use the product as much as it would be before buying the product in a regular store, for example, laptops but a request not to perform any manipulation, including activating the operating system pre-installed on the computer; for mobile phones - do not tear the protective films, switch on the product without inserting the SIM card and make calls, do not synchronize data, etc.
10. You are responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal.
11. Except for the cases specified in Paragraph 12 of these Regulations, you may exercise the right of withdrawal and unilaterally withdraw from the contract within 14 days by covering:
11.1. expenses for delivery of goods, which is not the cheapest standard delivery method offered by SIA “Wolteh”;
11.2. the direct costs of returning the goods, except in cases when SIA “Wolteh” has agreed to cover these costs or has not informed you that you have to cover the costs;
11.3. a decrease in the value of the goods, if the goods have been used for a purpose other than to ascertain the nature, characteristics and operation of the goods, which is confirmed by the diagnostics performed by the manufacturer of the goods at an authorized service. You are not responsible for the decrease in the value of the product if SIA “Wolteh” has not informed you about the right of withdrawal in accordance with the procedures specified in the regulatory enactments regulating the protection of consumer rights;

3. The consumer may not exercise the right of withdrawal:

12. In the cases specified in Paragraph 22 of Cabinet Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”, including if:
the price of the goods depends on financial market fluctuations which the seller cannot control and which may arise from the right of withdrawal within the time limit;
the goods are made according to the consumer's instructions or are clearly personalized;
the product is perishable or is about to expire;
the consumer has opened the packaging for a product which, for health and hygiene reasons, cannot be returned, such as an electric toothbrush, epilator, electric razor, beard / hair trimmer, electric hair clipper, in-ear audio headphones and the like nature goods, if the packaging of these goods has been opened and / or the security seal has been broken;
the product, due to its properties, will be irretrievably mixed with other things after delivery; the consumer has requested the seller or service provider to come and carry out urgent repairs or maintenance. If the seller or service provider, on arrival at the consumer, provides an additional service or supplies goods which are not necessary spare parts for repair or maintenance work, the right of withdrawal shall apply to those additional services or goods;
the consumer has opened the packaging of the audio or video recording or computer program;
a contract has been entered into for the supply of digital content which is not supplied on a durable medium, if the supply of digital content has been initiated with the consumer's prior express consent and confirmation of the loss of the right of withdrawal;
13. The online store eretail.lv does not store copies of the purchase agreement.

18. SIA Wolteh informs that if it finds that the value of the returned goods has been lost, it will apply to the court for compensation for the losses caused by SIA Wolteh as a result of the consumer's actions.
